TERMS OF USE

1. Introduction

These Terms of Use ("Terms") govern access to and use of the interview and candidate evaluation platform ("Platform") accessible at https://jobinterview.coach/ (the "Website").

Data Controller: JobInterview.coach, registered at Sepapaja tn 6, Tallinn 15551, Estonia The Data Controller determines the purposes and means of processing candidate personal data and is responsible for all hiring decisions.

Data Processor: JobMojito, operated by FreshMint ai OÜ, an Estonian entity with registered address at Sepapaja tn 6, 15551, Tallinn, Estonia. JobMojito delivers the platform technology, hosts data, and processes personal data on behalf of JobInterview.coach.

By accessing or using the Platform, you ("Candidate", "you") agree to these Terms. The Platform is used by JobInterview.coach for structured, AI-assisted interview and candidate evaluation workflows. Candidates access the Platform on invitation from JobInterview.coach.

2. Nature of the Service

The Platform:

  • Enables JobInterview.coach to define structured evaluation rubrics.

  • Generates AI-assisted summaries and scoring outputs.

  • May analyse limited behavioural or speech characteristics where configured by JobInterview.coach.

  • Does not autonomously accept or reject candidates.

  • Requires human review for final employment decisions.

AI outputs are assistive tools only.
Final hiring decisions remain solely with JobInterview.coach.

3. No Automated Decision-Making

The Platform does not make fully automated employment decisions within the meaning of applicable data protection laws.

The Platform:

  • Does not automatically reject or shortlist candidates.

  • Does not apply automatic filtering without human review.

  • Requires JobInterview.coach-controlled final decision-making.

JobInterview.coach is responsible for ensuring appropriate human oversight of all hiring decisions.

4. Configuration & Feature Controls

JobInterview.coach controls configuration of scoring components, including:

  • Rubric-based scoring

  • Behavioural and speech analytics (where available)

For EU employment deployments, behavioural scoring components may be disabled by default.
Biometric voiceprint functionality (if available) is disabled by default and may only be activated subject to separate agreement.
JobInterview.coach is responsible for determining whether specific features are appropriate for their jurisdiction and role requirements.

5. Data Protection

JobInterview.coach acts as Data Controller for candidate personal data processed through the Platform.
JobMojito acts as Data Processor, processing candidate data on behalf of JobInterview.coach.
Processing is governed by a separate Data Processing Agreement (DPA).
JobMojito does not use identifiable candidate interview data for AI model training or independent product development.

6. Intellectual Property

All intellectual property rights in the Platform, including software, algorithms, documentation, and AI components, remain the property of JobMojito or its licensors.
JobInterview.coach retains ownership of its data.

7. Acceptable Use

The Platform shall not be used:

  • In violation of employment, anti-discrimination, or data protection laws.

  • To attempt to reverse engineer the Platform.

  • To conduct unlawful profiling or discrimination.

  • To enable features in jurisdictions where such features are prohibited.

8. Service Availability

JobMojito will use reasonable efforts to maintain Platform availability.
The Platform is provided on an "as available" basis.
Maintenance, updates, and improvements may occur periodically.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • JobMojito shall not be liable for hiring decisions made by JobInterview.coach.

  • JobInterview.coach shall not be responsible for Platform technical failures outside its control.

  • Liability shall be limited to fees paid in the preceding 12 months.

Nothing in these Terms limits liability for fraud, wilful misconduct, or liability that cannot legally be excluded.

10. Governing Law

These Terms are governed by the laws of Estonia.
Any disputes shall be subject to the jurisdiction of the courts of Estonia, unless otherwise agreed in writing.

11. Modifications

These Terms may be updated periodically.
Material changes will be communicated appropriately.
